1. GENERAL

The Hirer undertakes to keep RAL’s components in good order and condition and to return all of the components to RAL in such order and condition. Whilst in the Hirer’s Possession the components must be transported and/or stored in clean dry conditions.


2. LIABILITY

No liability shall attach to RAL Display & Marketing Limited for:
(a) Any delay or failure to deliver due to circumstances which are outside RAL’s control.
(b) Skirting which have to be removed for the purpose of laying floor covering either in respect of loss or damage or for any cause incurred during re-fixing.
(c) Loss or damage howsoever caused to customer’s own goods
(d) Any dilapidation charges for fixing of floor coverings to exhibition hall or business/commercial premises floors


3. INSURANCE

The Hirer shall be responsible for maintaining adequate insurance both in respect of the components and in respect of any damage, loss or injury which may be caused to them whilst the components are under the control of the Hirer and until they are retaken and signed over (after inspection) into RAL’s possession.  Inspection by the Hirer of the components prior to leaving the premises of RAL is at the Hirer’s discretion. The Hirer’s responsibility commences at the time of collection or at the point the delivery is accepted.


4. DAMAGE

The Hirer shall be responsible for and shall reimburse RAL for the cost of any damage (including irremovable stains) done to the components while the same are under the control of the Hirer. In the event of RAL’s components becoming damaged or destroyed the customer will reimburse the full cost of repairing any damage or the current list price of replacing the components damaged beyond repair. Whether damage done to a component is so grave as to necessitate its replacement shall be at the sole discretion of RAL


5. COLLECTION & RETURN

It is the Hirer’s responsibility to collect and return the component’s to the premises of RAL unless other arrangement are agreed in writing between the Hirer and RAL.  If the Hirer fails to return any items, the Hirer agrees to pay compensation equal to the current list price of the non-returned components.  In addition, the Hirer shall pay a charge equal to any sums lost by RAL through failure to hire the non-returned components.


6. MAINTENANCE OR ALTERATION

On no account unless agreed in writing will any maintenance or alterations be carried out on components whilst on hire by any person other than RAL.  Should any work be required then there may be an additional charge to cover costs incurred.


7. SPECIFICATION

RAL reserve the right to alter specifications or prices without prior notice.


8. PACKAGING

All packaging, boxes or containers used in the hire of RAL’s components are the property of RAL and shall be returned with the components. The Hirer agrees to pay RAL compensation equal to the replacement value of packaging, boxes or containers which are beyond repair or have not been returned to RAL.


9. FIXING MATERIAL

All standard hire panels are covered both sides in a fabric to be used in conjunction with Velcro tabs/tapes only. PINS, DRAWING PINS, NAILS, SCREWS, GLUE, BLU-TAC AND ADHESIVE TAPES WILL DAMAGE THE FABRIC AND PANEL AND THEREFORE MUST NOT BE USED.


10. PAYMENT

The minimum charge hire period is 24 hours.  No deposit is required but the Hirer is responsible for adequate insurance as indicated in paragraph 3 of these Terms and Conditions of Hire. Payment is required in full (incl. V.A.T) before the agreed collection date, and where applicable plus delivery and or installation/dismantle charges. All prices are subject to V.A.T.


11. HIRE EXTENSIONS

Any extensions to the hire period whilst in the possession of the Hirer will require a signed and amended, or renewed Agreement accompanied by payment (inc. V.A.T.) prior to acceptance of the extension by RAL.


12. CANCELLATION

Cancellation by the Hirer must be forwarded in writing to these offices, no later than five (5) working days prior to the agreed date of collection and where applicable delivery/installation.  Any cancellation by the Hirer not received in writing at these offices or in less that five (5) working days are without prejudice subject to a 25% cancellation fee (minimum £15.00 plus V.A.T.) of the total value of the hire components originally to be charged including delivery/installation where applicable.  Verbal cancellations are not accepted.


13. INSOLVENCY

If the Hirer defaults in punctual payment of any account when due, or in the case of death, incapacity, bankruptcy or insolvency, or, where the Hirer is a company, in the case of liquidation or the appointment of a receiver, the hire if all components invoiced and/or collected and the cost of all work already invoiced and/or carried out shall immediately become due. In addition on the occurrence of any such event RAL shall have the right to cancel any contract with the Hirer and/or to retake possession of all components hired to the Hirer and/or to suspend collection of RAL’s components or the execution of further works under contract, without prejudice to their right to recover any loss sustained.


14. RIGHTS

 

RAL shall be entitled to assign any or all of its rights and to perform any of its obligations through sub-contractors. RAL shall be entitled as its discretion to release any Hirer from all or any of the above obligations.


15. ENTIRE CONTRACT

 

These Terms and Conditions constitute the entire contract between Hirer and Vendor, transcending any oral arrangements or representation which may be consistent therewith.  All warranties and conditions, expressed or implied, except as indicated in these Terms and Conditions, are expressly excluded.


16. LEGAL CONSTRUCTION

The contract shall in all respects be constructed and operate as an English contract and shall be governed by English law. The courts of England and Wales shall have exclusive jurisdiction.
